Fusion Xtreme Cheer and Dance
Participant Waiver, release of liability and code of conduct agreement.
Acknowledgement of Risks
In consideration of being permitted to participate in any Fusion Xtreme cheer and dance classes, practices, training sessions, camps, competitions, performances, travel and related activities ("Activities"), I acknowledge and agree that participation is voluntary and involves inherent risks.
I understand that cheerleading and dance are physically demanding activities involving, but not limited to:
- Running
- Jumping
- Tumbling
- Stunting
- Lifting
- Catching
- Throwing
- Rotational Movements
- Gymnastics Skills
- Dance Choreography
I understand that these activities involve risks that cannot be completely eliminated, even when appropriate safety measures are followed.
Possible injuries include, but not limited to:
- Falls
- Being lifted, caught or dropped
- Contact with teammates
- Equipment failure
- Uneven surfaces
- Physical Exertion
- Accidental Collisions
- Acts of other participants
Participant Responsibilities
To help minimise the risk of injury, I agree that I/my child will:
- Wear appropriate athletic clothing that allows unrestricted movement. (No Denim)
- Wear appropriate Dance or cheer shoes
- Keep Long hair securely tied back
- Remove all jewellery before participating
- Arrive prepared and participate in all required warm ups
- Never stunt, tumble or practice advanced skills without Coach supervision
- Follow all instructions given by coaches and officials
- Behave respectfully and avoid disruptive or unsafe behaviour
If I become aware of unsafe conditions, damaged equipment, or unsafe behaviour, I will immediately notify a coach or Fusion Xtreme staff member.
Illness and Communicable Disease Policy
To help protect the Health and Safety of all athletes, coaches, volunteers and families, participants must not attend any Fusion Xtreme cheer and dance activity if they are experiencing symptoms of contagious illness or have been advised by a medical professional to isolate or avoid group activities.
This includes, but not limited to, fever, vomitting, diarrhoea, influenza (flu), COVID-19, chicken pox, impetigo, conjunctivitis or any other contagious illness.
If an athlete becomes unwell during an activity, Fusion Xtreme reserves the right to contact the parent/guardian and request that the athlete be collected as soon as reasonably possible.
Parents/Guardians are responsible for ensuring the athletes are medically fit before returning to participation.
Code of Conduct
Fusion Xtreme is committed to providing a safe, respectful and positive environment for all participants.
Athletes agree to:
- Treat coaches, teammates, families, officials, volunteers with respect
- Follow all coaching instructions
- Display good sportsmanship at all times
- Refrain from bullying, harassment or intimidation
- Avoid abusive, threatening or discriminatory behaviour
- Refrain from posting or re-posting defamatory or derogatory comments or posts about Fusion Xtreme, its coaches, athletes, volunteers or any other cheerleading organisations/companies on social media or public forums
- Behave in a manner that reflects positively on the club both in person and online.
Serious or repeated breeches of the code of conduct may result in suspension or removal from the program.
Right to Refuse Participation
Fusion Xtreme Cheer and Dance reserves the right to refuse or suspend participation where in the reasonable opinion of the club, an athlete's or parent/guardian's behaviour presents a safety risk, breeches club policies, fails to comply with coaches instructions, or negatively effects the welfare of other participants. Any such decision will be made fairly and in the best interests of the club and it's members.
Assumption of Risk
I fully understand and voluntarily accept all known and unknown risks associated with participating in the activities.
I acknowledge that injury may occur despite proper coaching, supervision, equipment and safety procedures.
I voluntarily choose to participate and accept full responsibility for any injury, illness, damage or loss that may result.
Release of Liability
To the fullest extent permitted by law, I, on behalf of myself, my child (if applicable), my spouse, heirs, executors, administrators and personal representatives, release, waive and discharge Fusion Xtreme Cheer and Dance, its owners, directors, coaches, volunteers, officials, staff, sponsors, venue owners and event organisers from any claims, demands, actions or causes of action arising from participation in the activities, except where liability cannot legally be excluded due to negligence or applicable law.
Medical Consent
I confirm that I/my child am/is physically fit to participate.
I understand it is my responsibility to disclose any medical conditions, injuries or medications that may affect safe participation.
In the event of illness or injury, I authorise Fusion Xtreme Cheer and Dance to obtain emergency medical treatment if I cannot be contacted immediately. I understand that I am responsible for any associated medical expenses.
Photography and Video Consent
I understand that photograph and video recordings may be taken during classes, practices, competitions and authorised events.
I grant Fusion Xtreme Cheer and Dance permission to use photographs and recordings of myself/my child for coaching, promotional, educational, advertising and social media purposes without compensation.
I understand that I waive any right to inspect or approve the final use of these images and recordings.
Fees and Refunds Policy
I acknowledge that participation in Fusion Xtreme Cheer and Dance requires financial commitments that support coaching. venue hire, insurance, competition entry fees and the operation of the program.
Unless otherwise agreed in writing or required by law, membership fees, tuition fees, competition fees and other program payments are non refundable,including where an athlete chooses to withdraw, is unable to participate due to injury or illness or is removed from the program for breaching club policies or the code of conduct.
Fusion Xtreme may, at it's sole discretion, consider exceptional circumstances on a case by case basis. Any approved refund or credit remains entirely at the discretion of Fusion Xtreme unless otherwise required by law.
Club Policies
I confirm that I have read, understood and agree to comply with all Fusion Xtreme Cheer and Dance policies, procedures and rules.
Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of England and Wales.
Any dispute arising out of or relating to this agreement or participation in Fusion Xtreme Cheer and Dance activities shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Severability
If any provision of this agreement is found by a court of competent jurisdiction to be unlawful, invalid or unenforceable, that provision shall be deemed severed from the agreement to the minimum extent necessary. The remaining provisions shall continue in full force and effect.
Acknowledgement
I certify that I have carefully read this agreement in its entirety.
I understand its contents and acknowledge that by signing this agreement I am giving up a certain legal right.
I sign this agreement voluntarily and without coercion.
